Question

May a part-time municipal court judicial officer represent retained criminal defendants in another municipal court in the same county when another law firm provides the prosecutor services in both municipal courts?

Answer

The Code of Judicial Conduct does not prohibit a part-time judicial officer from representing retained criminal defendants in another municipal court in the same county when another law firm provides the prosecutor services in both municipal courts. The only restriction is that the part-time judicial officer cannot act as a lawyer in a proceeding in which the judicial officer has served or in any other proceeding related thereto.
